The Attorney General's Solicitor General Division oversees all appellate litigation involving the State of West Virginia, along with state officers, agencies, and boards. The division practices at all levels in state and federal courts, including before the U.S. Supreme Court.
Beyond appellate work, the division maintains an active docket of cases of special interest to the Attorney General. The division handles constitutional challenges to state laws, defends West Virginia's interests in multistate litigation, files lawsuits on behalf of the State, authors significant legal briefs (including amicus briefs), drafts policy letters, provides occasional legal counsel to state agencies and officials, and helps shape the State's legal strategy on matters of public importance. In recent years, the division has focused heavily on national matters involving constitutional law, statutory interpretation, and administrative overreach.
The Solicitor General Division also assists the Attorney General in issuing Attorney General Opinion Letters.
