The Solicitor General welcomes applications from recent and soon-to-be law school graduates (graduation years 2024-2026) for a fellowship in the Solicitor General’s group.
About the Solicitor General Group
West Virginia's Solicitor General group litigates before the U.S. Supreme Court and handles the State's most significant constitutional cases. The group won West Virginia v. EPA and is currently litigating West Virginia v. BPJ, described as one of the most important cases of the term.
The group also litigates cases of significant concern to the Attorney General (including litigation against the federal government and other States), defends key West Virginia laws against constitutional challenges, works with other divisions to handle the most impactful state litigation, drafts opinion letters, and provides strategic advice.
The Caldwell Fellowship Program
The fellowship program is designed for lawyers interested in gaining substantive appellate litigation experience in a practice group focused on federalism and the role of state litigants in state and federal courts.
Fellows will take significant responsibility for their matters and contribute at highly substantive levels. Using their experience in West Virginia, fellows have gone on to secure federal clerkships and assume distinguished government positions, among other things.
Working alongside the Solicitor General and senior attorneys, fellows can expect substantial appellate, administrative, and general litigation opportunities. Fellows may draft appellate briefs, dispositive motions, and administrative comments; write Attorney General Opinions; serve as moot court judges; and provide strategic advice on high-profile matters to the Solicitor General, Attorney General, and other state officers.
The fellowship may also involve oral argument opportunities in the Supreme Court of Appeals of West Virginia, as well as formal and informal training opportunities.
Fellows will serve one-year or two-year full-time terms based on interest and the Office’s needs. Anticipated start dates are in late summer and fall 2026. The fellowship includes a competitive public sector salary and benefits.
Fellowship positions are based out of scenic Charleston. Charleston is rich in historic architecture, an eclectic music scene, unique dining, and four seasons of changing mountain landscape. The capital city serves as the gateway to skiing, rafting, hiking, fishing, climbing, and more.
Qualifications
Applicants must possess a J.D. degree by the time they start their fellowship. Excellent research and writing skills are required. Although all interested candidates with strong credentials are encouraged to apply, this program is ideally suited for applicants with:
• Federal or state clerkship experience;
• Top 20% class ranking or law review membership at nationally ranked law schools;
• Substantive experience in appellate or administrative law, whether in public or private practice; or
• Participation in moot court, mock trial, or similar law school advocacy programs.

A. Bolton Caldwell was West Virginia’s first and fifth Attorney General. A graduate of Harvard Law School and former U.S. Attorney, state prosecutor, and West Virginia circuit court judge, Caldwell shepherded the Office of the Attorney General through its earliest years following West Virginia’s creation as a State.
Assistant Attorney General, WV Medicaid Fraud Control Unit (MFCU)
This position is located in the Medicaid Fraud Control Unit (MFCU) of the West Virginia Attorney General, which is tasked by the Office of Inspector General (OIG) of the US Department of Health and Human Services (HHS) with investigating and prosecuting provider fraud in the medical programs of the state, as well as allegations of abuse, neglect, and financial exploitation of incapacitated adults.
The Assistant Attorney General will primarily handle investigations and civil actions against Medicaid providers alleged to have committed complex health care fraud schemes under the Supervision of the Deputy Director. These matters are pursued under the West Virginia Medicaid Fraud Statute and the Federal False Claims Act. The Unit often works in conjunction with federal partners in US Attorneys’ Offices, HHS OIG, and others. State and national training opportunities are available to aid employees in understanding the complexities of health care fraud investigations. As part of their duties, the Assistant Attorney General will likely have the opportunity to pursue appointment as a Special Assistant United States Attorney (SAUSA). As part of that process, the Attorney will be subject to a federal background check.
While the majority of the Attorney’s practice will be focused on the investigation and Litigation of complex civil matters related to health care providers, they will also work closely with the Assistant Attorney General handling criminal matters, and will have the opportunity to be co-counsel, and/or handle cases as a special assistant prosecuting attorney throughout the State.
Additional Duties as assigned may include:
• Analyzing case referrals to determine whether the allegations warrant opening an investigation and/or pursuing enforcement action.
• Responsibility for negotiating and drafting civil settlement agreements in complex (often multi-state) civil investigations and actions.
• Pursuit of False Claims Act cases in federal court. Sometimes this is done with the Attorney acting in their capacity as a Special Assistant United States Attorney (SAUSA), and sometimes they pursue the case jointly on behalf of the State with an Assistant United States Attorney acting on behalf of the federal government.
• They may also be responsible for handling, assisting, and supporting criminal investigations and prosecutions as requested by the Deputy Director. When an action is being litigated by the Unit, the Attorney will be responsible for all aspects of the litigation, to include discovery, motions practice, witness preparation (to include expert witnesses), and trial.
This is a salaried position and may require some overtime.
Travel, including some overnight stays will be required.

- Active license to practice law in West Virginia.

- Applicants with civil practice experience are strongly preferred.

Assistant Solicitor General
The West Virginia Attorney General's Office is accepting applications from attorneys interested in serving as an Assistant Solicitor General. This unique opportunity offers attorneys a chance to work on matters of exceptional complexity and importance to the State.
The Solicitor General oversees and manages all appellate work in the Office of the Attorney General, as well as certain strategic litigation of special concern to the Attorney General. The SG group’s appellate-heavy docket thus includes both civil and criminal matters and spans all practice areas across the Office. The group also works on statewide and national cases involving federalism, constitutional matters of first impression, and other significant issues for the State.
SG group attorneys practice at all levels in state and federal courts, including before the U.S. Supreme Court. And as members of a small team, all SG group attorneys contribute at highly substantive levels and can expect significant appellate, administrative, and general litigation experience.
Assistant Solicitors General draft appellate briefs (including party and amicus briefs), dispositive motions, and administrative comments; write Attorney General Opinions; coordinate with other Attorney General offices on multistate efforts; manage day-to-day litigation matters; and research, analyze, and consult on other issues of importance to the Attorney General and other constitutional officers. Assistant Solicitors General can also expect oral argument opportunities, most often in West Virginia’s intermediate and supreme courts.
At least four years of professional experience and excellent writing skills are required. A clerkship or prior experience in appellate litigation is particularly beneficial.

Bankruptcy Attorney
The West Virginia Attorney General’s Office seeks an attorney to join the Tax & Revenue, Legislative Claims Commission and Transportation Division. Ideal candidates will have at least three (4) years’ experience in bankruptcy law, preferably on the creditor side.
Responsibilities will include, but not be limited to:
Provide expert legal counsel and representation to state agency clients seeking to collect judgments, tax liabilities, and other claims from entities that have entered bankruptcy.
Assist state agency clients in understanding their rights and obligations in bankruptcy proceedings.
Prepare and file necessary legal documents to preserve priority of state agency claims and liens.
Represent state agency clients in bankruptcy hearings, negotiations, and court proceedings.
